1. Introduction
Free Sharks is committed to protecting the privacy and safety of all participants engaging in courses, workshops, training sessions, photoshoots, and excursions. This policy outlines how participant information is collected, stored, and used, as well as the conditions of participation, payment, and refunds.
Participation in any Free Sharks activity requires the participant to read, understand, and sign the Participation Agreement, which includes the Liability Release and Assumption of Risk, Medical Declaration and Statement, and Photography Release. These signed documents form a legally binding contract between the participant and Free Sharks.


2. Collection and Use of Personal Data
Free Sharks collects personal information provided by participants, including but not limited to:

• Full name, contact details, and date of booking
• Medical declaration and relevant health information for safety purposes
• Signatures on required participation documents
• Images, videos, and audio captured during activities

This information is used solely for:

• Managing bookings and providing agreed services
• Ensuring participant safety and compliance with medical requirements
• Legal and liability protection for both parties
• Marketing and promotional purposes when explicit consent is given in the Photography Release section of the Participation Agreement

All personal data is stored securely and is not sold or shared with third parties, except where required by law or in the event of a medical emergency.


3. Required Signed Documents
Before participating in any Free Sharks activity, each participant must read and sign:

2. Liability Release and Assumption of Risk
3. Medical Declaration and Statement
4. Photography Release (optional for minors with parental consent required)

Failure to complete and submit these documents will result in denial of participation without refund.


4. Payment, Deposits & Refund Policy
All payments made to Free Sharks are non-refundable.

• A deposit is required at the time of booking to secure the participant’s spot.
• If the participant cancels the booking, the deposit is forfeited and will not be refunded under any circumstances.
• In the event Free Sharks cancels the activity due to safety concerns, extreme weather, or other unforeseen conditions, an alternative date will be offered. If rescheduling is not possible, a credit may be applied for a future booking at Free Sharks’ discretion.
• No refunds are provided for no-shows, late arrivals, or participants dismissed from activities due to unsafe behavior or failure to follow instructions.

5. Assumption of Risk
Freediving and underwater breath-hold activities involve inherent risks, including but not limited to hypoxia, shallow water blackout, barotrauma, marine life interactions, drowning, or hyperbaric accidents. By signing the Participation Agreement, the participant acknowledges these risks, assumes full responsibility for their participation, and releases Free Sharks and its representatives from all liability.


6. Photography & Media Rights
By signing the Photography Release, the participant grants Free Sharks permission to capture and use their likeness in photographs, videos, and other media for editorial, promotional, advertising, and commercial purposes, without time or geographic limitations.


7. Minors
Participants under 18 years of age must have all agreements signed by a parent or legal guardian before participation.
